Terms of Service

Please read these terms of service carefully before using DailyStreak.

1. Introduction & Agreement

Welcome to DailyStreak ("Platform," "we," "us," or "our"). DailyStreak is a sports engagement platform available as a mobile application on iOS and Android and via the web at dailystreak.win. Users make predictions on sporting events, earn credits, compete in contests, and redeem rewards.

By accessing or using DailyStreak, whether through the mobile app or website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.

We reserve the right to update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the modified Terms. We will notify users of material changes through the Platform.

2. Eligibility

To use DailyStreak, you must:

  • Be at least 18 years of age or the age of majority in your jurisdiction, whichever is greater
  • Reside in a jurisdiction where participation is legal
  • Have the legal capacity to enter into a binding agreement
  • Not be prohibited from participating due to prior violations or legal restrictions

DailyStreak reserves the right to verify your eligibility and may request identification documents at any time.

3. Account Registration & Security

To access certain features, you must create an account using one of our supported sign-in methods (Google, Apple, Facebook, or email/password). When registering, you agree to:

  • Provide accurate, current, and complete information
  • Maintain the security of your login credentials
  • Accept responsibility for all activity under your account
  • Notify us immediately of any unauthorized access
  • Maintain only one account per person

Username Requirements: Usernames must be 3–50 characters long and may only contain letters, numbers, and underscores. Usernames are case-insensitive and must be unique.

We reserve the right to suspend or terminate accounts that violate these requirements or engage in suspicious activity.

4. Credits & Virtual Currency

DailyStreak uses a virtual currency system called "Credits." Important terms regarding Credits:

  • No Cash Value: Credits are virtual items with no inherent monetary value and cannot be exchanged for cash directly
  • Purchases: Credits may be purchased through the Apple App Store, Google Play Store (as in-app purchases), or via Stripe on the web
  • In-App Purchases: Mobile purchases are processed entirely by Apple or Google and are subject to their respective terms of service and refund policies
  • Non-Transferable: Credits cannot be transferred, sold, or exchanged between users
  • Non-Refundable: All credit purchases are final and non-refundable except as required by law or the applicable app store's refund policy
  • Daily Credits: Users may receive free daily credits as part of platform promotions
  • No Expiration: Unused credits remain in your account indefinitely unless your account is terminated

Credits may be used for contest entry fees and may be redeemed for rewards as described in Section 7.

5. Gameplay & Picks

DailyStreak allows users to make predictions ("Picks") on sporting events. Key gameplay terms:

  • Streak Picks: Make predictions on sporting events and build consecutive winning streaks
  • Monthly Resets: Streaks reset at midnight Central Time (CT) at the beginning of each calendar month
  • Pick Costs: Some questions may require credits to participate; free picks are also available
  • Deadlines: All picks must be submitted before the question deadline; late picks are not accepted
  • Outcomes: Question outcomes are determined based on official results from authoritative sources
  • Best Streaks: Your best streak is calculated as the most consecutive correct picks within a calendar month

DailyStreak reserves the right to void, cancel, or adjust picks in cases of errors, technical issues, or suspicious activity.

6. Contests

DailyStreak offers contests where users compete for credit prizes. Contest terms:

  • Entry Fees: Contests may require credit entry fees, which are deducted upon joining
  • Prize Pools: Prize pools may be static (fixed amount) or dynamic (grows based on participation)
  • Dynamic Pools: Calculated as participant count × entry cost × 0.7
  • Winners: Winners receive credits based on their final ranking and the prize distribution structure
  • Tiebreakers: In case of ties, tiebreaker questions may be used to determine final rankings
  • Contest Picks: Picks made in contests are tracked separately from standard picks
  • Winner Notifications: Winners are notified via the Platform's messaging system

DailyStreak reserves the right to cancel, modify, or void contests due to technical issues, insufficient participation, or rule violations.

7. Rewards & Redemptions

Credits may be redeemed for rewards subject to the following terms:

  • Minimum Redemption: A minimum of 15 credits is required to redeem for rewards
  • Conversion Rate: Credits are converted to cash value at a rate of 0.8x (e.g., 15 credits = $12.00)
  • Available Rewards:
    • Visa e-Gift Cards
    • Mastercard e-Gift Cards
    • Venmo transfer
    • Cash App transfer
  • Fulfillment: Rewards are fulfilled through our third-party provider, Tremendous
  • Processing Time: Redemptions are subject to review and may take several business days to process
  • Fraud Prevention: Redemptions are subject to fraud prevention checks; suspicious activity may result in delays or denial
  • Non-Refundable: Once issued, rewards cannot be refunded or exchanged
  • Lost/Stolen: DailyStreak is not responsible for lost or stolen gift cards after issuance

DailyStreak reserves the right to modify reward options, conversion rates, and redemption requirements at any time.

9. Standings & Rankings

DailyStreak maintains leaderboards and standings:

  • Best Streaks Leaderboard: Rankings based on longest consecutive correct picks
  • Monthly Standings: Reset at the beginning of each calendar month
  • All-Time Standings: Cumulative rankings based on best streaks achieved
  • Leaderboard Rewards: Top 3 monthly finishers may earn credit rewards
  • Rank Movement: Rank changes are tracked and displayed on standings pages

DailyStreak reserves the right to adjust standings in cases of errors, fraud, or rule violations.

10. Leagues

DailyStreak offers a Leagues feature for private competitions:

  • Creation: Users may create private leagues and invite others to join
  • Access Codes: League access is controlled via unique, case-sensitive codes
  • Approval: League creators may require approval before new members can participate
  • Co-Creators: League creators may designate co-creators with full administrative permissions
  • Groups: Leagues may be organized into groups for tournaments and competitions
  • Visibility: Leagues are only visible to creators, co-creators, and approved participants

League creators are responsible for managing their leagues in accordance with these Terms.

11. Push Notifications

DailyStreak may send push notifications to your mobile device, including:

  • Contest updates, new contest announcements, and entry reminders
  • Pick results and streak milestone notifications
  • Promotional offers, bonus credit opportunities, and new features
  • Important platform announcements and policy changes

You can opt out of push notifications at any time through your device's notification settings. Opting out will not affect your ability to use the Service.

12. Messaging & Communications

DailyStreak may communicate with users through:

  • Platform Inbox: In-app notifications and messages
  • Broadcast Messages: Platform-wide announcements
  • Winner Notifications: Automated messages for contest winners
  • Support Communications: Responses to user inquiries

By using the Platform, you consent to receive these communications. You may manage notification preferences in your account settings.

13. Prohibited Conduct

Users are strictly prohibited from:

  • Using bots, scripts, automation tools, or artificial intelligence to make picks
  • Exploiting bugs, vulnerabilities, or technical errors in the Platform
  • Creating or using multiple accounts
  • Engaging in harassment, abuse, or threatening behavior toward other users or staff
  • Committing fraud, money laundering, or other illegal activities
  • Manipulating picks, standings, or outcomes through coordinated activity
  • Misusing the referral program or promo codes
  • Sharing account credentials with others
  • Circumventing geographic restrictions or eligibility requirements
  • Interfering with the proper functioning of the Platform
  • Misrepresenting your identity, age, or location

Violations may result in immediate account suspension, forfeiture of credits, and permanent ban from the Platform.

14. Intellectual Property

All content, features, and functionality of DailyStreak, including but not limited to:

  • The DailyStreak name, logo, and branding
  • Mobile application and website design, layout, and user interface
  • Software, code, and algorithms
  • Text, graphics, images, and other content

are the exclusive property of DailyStreak or its licensors and are protected by copyright, trademark, and other intellectual property laws. Users may not copy, modify, distribute, sell, or exploit any content without express written permission.

15. Mobile Application Terms

The following additional terms apply when you access DailyStreak through our mobile application:

  • Your use of the app is also subject to the terms and conditions of the Apple App Store or Google Play Store from which you downloaded it
  • You acknowledge that these Terms are between you and DailyStreak only, not with Apple or Google
  • Apple and Google and their subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you
  • DailyStreak, not Apple or Google, is solely responsible for the app and its content
  • App updates may be required for continued use; you agree to install updates as they become available
  • In the event of any failure of the app to conform to any applicable warranty, you may notify Apple or Google for a refund of the purchase price (if any); beyond that, Apple and Google have no warranty obligation with respect to the app

16. Account Suspension & Termination

DailyStreak may suspend or terminate your account for:

  • Violations of these Terms of Service
  • Fraudulent or suspicious activity
  • Failure to verify identity or eligibility
  • Extended account inactivity
  • Any reason at our sole discretion

Upon termination, your right to use the Platform ceases immediately. Credits and unredeemed rewards may be forfeited. You may request account deletion through your profile settings or at dailystreak.win/data-deletion.

17. Disclaimers

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Guarantees regarding the accuracy of predictions or outcomes
  • Guarantees of credit availability or redeemability
  • Uninterrupted or error-free service
  • Security of data or protection from unauthorized access

DailyStreak does not guarantee any specific outcomes, winnings, or rewards. Participation is at your own risk.

18. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DAILYSTREAK AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, or opportunities
  • Loss of credits or inability to redeem rewards
  • Damages arising from unauthorized access to your account
  • Damages resulting from actions of third-party service providers

Our total liability shall not exceed the amount of credits you purchased in the twelve (12) months preceding the claim.

19. Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be:

  • Governing Law: Governed by the laws of the State of Delaware, without regard to conflict of law principles
  • Informal Resolution: We encourage you to contact us first to resolve disputes informally
  • Binding Arbitration: Any unresolved disputes shall be resolved through binding arbitration administered by the American Arbitration Association
  • Class Action Waiver: You agree to resolve disputes individually and waive any right to participate in class actions

20. Modifications to Service

DailyStreak reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time, including but not limited to:

  • Features and functionality
  • Game rules and mechanics
  • Reward options and redemption rates
  • Credit pricing and availability
  • Contest structures and prizes

We will provide reasonable notice of material changes when possible. Continued use after changes constitutes acceptance.

21. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

22. Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and DailyStreak regarding your use of the Platform and supersede all prior agreements and understandings.
